1. About these terms

These Terms and Conditions (“Terms”) govern your access to and use of the Key2Car website at key2car.co.uk and any related services, features and tools (together, the “Platform”). The Platform is operated by Key2Car Limited (“Key2Car”, “we”, “us”, “our”), a company registered in England and Wales under company number 16949981, with its registered office at Ferry Lane, TW19 6HG.

By accessing or using the Platform, creating an account, or listing or enquiring about a vehicle, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform.

2. Who we are and what Key2Car is

Key2Car is an online marketplace and advertising platform. We allow private sellers and trade (dealer) sellers to advertise vehicles, and we allow buyers to browse those advertisements and contact sellers directly. Our services include vehicle listings and search, a free vehicle check, a finance calculator, per-listing running-cost estimates, buyer accounts (including saved cars and messaging), and dealer advertising subscriptions.

Key2Car is not a car dealership, motor trader or auction house. We do not own, buy, sell, supply, store, inspect, prepare, warrant or deliver any vehicle advertised on the Platform. Every vehicle is sold directly by the seller who lists it.

Any contract for the sale or purchase of a vehicle is formed solely between the buyer and the seller. We are not a party to that contract, we do not act as agent for either party, and we have no responsibility or liability for any vehicle, its condition, description, roadworthiness or ownership, or for the acts or omissions of any buyer or seller.

We do not provide finance, credit, insurance, warranties or guarantees, and we are not a lender, credit broker, credit intermediary or financial adviser. We charge sellers advertising fees and subscriptions to list vehicles; we do not charge commission on any sale.

3. Definitions

• Platform – the Key2Car website, apps, tools and services.
• Buyer – a user who browses listings and/or contacts sellers.
• Seller – a user who advertises a vehicle, whether a Private Seller (an individual selling their own vehicle) or a Trade Seller / Dealer (a business selling in the course of trade).
• Listing – an advertisement for a vehicle placed by a Seller.
• Content – any text, images, data or other material submitted to the Platform.

4. Eligibility and your account

You must be at least 18 years old and able to enter into a legally binding contract to use the Platform. When you create an account you must provide accurate, current and complete information and keep it up to date.

You are responsible for keeping your login details confidential and for all activity that takes place under your account. You must notify us promptly at info@key2car.co.uk if you suspect any unauthorised use. You may hold one account only, unless we agree otherwise. We may suspend or close accounts in accordance with these Terms.

5. Using Key2Car as a buyer

Listings are created by Sellers, not by Key2Car. We do not verify, and are not responsible for, the accuracy or completeness of any Listing or any vehicle’s description, history, condition or price.

You are responsible for carrying out your own due diligence before buying, including viewing the vehicle in person, checking its documents (such as the V5C), and obtaining an independent inspection and an independent history/provenance check. Our Buying Safely guide sets out sensible checks. You contact and deal with Sellers directly and at your own risk. Please use the Report a Seller tool to report anything suspicious.

6. Selling and listing vehicles

If you list a vehicle, you are responsible for ensuring your Listing is accurate, lawful, not misleading, and that you have the legal right to sell the vehicle. Trade Sellers must comply with all applicable consumer-protection laws (including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008).

Private sellers vs trade sellers

Private-seller accounts are for genuine private individuals selling their own personal vehicles. If you sell vehicles in the course of a business, you are a Trade Seller and must use a trade/dealer account.

You must promptly mark vehicles as sold or remove Listings once a vehicle is no longer available, and you must keep your Listings accurate and up to date.

7. Fees, subscriptions and payment

Advertising fees for private listings and dealer subscription packages are set out on the Platform (for example on our Sell Your Car and Dealer Pricing pages). We do not charge commission on any sale.

Fees are payable in advance. Subscriptions renew automatically for successive periods until cancelled in accordance with the terms shown at purchase. Payments are processed by third-party payment providers; we do not store your full card details. Fees are stated inclusive or exclusive of VAT as indicated at the point of purchase. Your cancellation and refund rights are as described at purchase and as required by law. We may change our fees from time to time and will give notice of changes affecting ongoing subscriptions.

8. Vehicle data and the free vehicle check

The Platform offers a free vehicle check that can display information such as tax status, MOT history and recorded mileage for a given registration. This information is obtained from third-party data providers and official sources, including the DVLA and DVSA.

This data is provided on an “as is” basis and for general guidance only. We do not control it, and we do not guarantee that it is accurate, complete or up to date. It is not a substitute for your own checks and inspection.

9. Calculators and estimates

The per-listing running-cost calculator and the finance calculator are provided for illustration only. All figures they produce — including fuel, real-world MPG, road tax, insurance, servicing, annual running costs, and any monthly payment amounts — are estimates based on assumptions and the information entered. They will not necessarily reflect your actual costs, and they are not a real, guaranteed or personalised figure.

10. Content and intellectual property

All intellectual property rights in the Platform (including its design, text, graphics and software) belong to Key2Car or our licensors. When you submit Content (such as a Listing), you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and promote that Content for the purpose of operating and marketing the Platform, including across our social channels. You confirm that you own or have the right to use any Content you submit. You must not copy, scrape, republish or systematically extract any part of the Platform without our written permission.

11. Prohibited use

You must not: use the Platform for any unlawful, fraudulent or misleading purpose; post inaccurate, deceptive or unlawful Listings; list a vehicle you do not have the right to sell; use bots, scrapers or automated means to access the Platform; introduce malicious code; attempt to gain unauthorised access to the Platform or other users’ accounts; circumvent fees or the private-seller limit; harass, abuse or impersonate others; or otherwise breach these Terms or any applicable law.

12. Third-party services

The Platform integrates with and links to third-party services, including payment providers, vehicle-data providers, analytics and advertising services, and messaging/chat tools. We are not responsible for third-party websites or services, and your use of them is subject to their own terms and policies.

13. Disclaimers

The Platform is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free or secure, or that any information, Listing, Seller or Buyer is accurate, genuine or reliable. As set out above, we are a marketplace only and are not responsible for any vehicle or for any transaction between a Buyer and a Seller.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Subject to that, we are not liable for: any sale, purchase, vehicle, or dealing between a Buyer and a Seller; the accuracy of any Listing, vehicle data, or calculator estimate; or any indirect or consequential loss, or loss of profit, income, data or goodwill. Our total liability to you arising out of or in connection with the Platform, whether in contract, tort (including negligence) or otherwise, is limited to the total fees you paid to us in the 12 months before the event giving rise to the claim (or £100 if you have paid no fees). If you are a consumer, this section does not affect your statutory rights.

15. Indemnity

If you are a Seller or business user, you agree to indemnify us against all losses, liabilities, costs and expenses that we suffer arising from your Listings, your use of the Platform, or your breach of these Terms or of any applicable law.

16. Suspension and termination

We may suspend, restrict or terminate your access to the Platform or any account, and remove any Listing, if we reasonably believe you have breached these Terms (including the private-seller fair-use limit), if we suspect fraud or unlawful activity, or where necessary to protect the Platform or other users. You may close your account at any time. Termination does not affect any rights or obligations that accrued before it.

17. Reporting concerns

If you come across a Listing or user that appears fraudulent, unlawful or unsafe, please tell us using the Report a Seller page or by emailing info@key2car.co.uk so we can investigate.

18. Changes to these terms

We may update these Terms from time to time to reflect changes to our services, the law or our practices. The “last updated” date above shows when they were last changed. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

19. Governing law

These Terms and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
